Coal Miners Represented by Peiffer Wolf Carr & Kane Receive Final Approval of WARN Act Class Action Settlement

On January 23, 2017, the United States District Court for the Central District of Illinois granted final approval of a class action settlement in the matter Carver, et al., v. Foresight Energy LP, et al. Case No. 3:16-cv-3013.

In August 2016, after approximately seven months of litigation, the parties reached a class-wide settlement. The settlement received preliminary approval in October 2016.

The final approved settlement, provides for a settlement fund of $550,000.00 for a class of 74 former coal miners who worked at the Deer Run Mine in Hillsboro, Illinois. As part of the settlement, Defendants do not admit liability.

“The settlement approved by the Court provides meaningful relief to 74 class members,” said attorney Brandon Wise, counsel for the Class. “I am pleased with the result reached in the case, and am glad our hardworking coal miners will benefit from the settlement. As the son of a former coal miner, I know the class members work one of the toughest jobs around.”

One of the first plaintiffs in the matter, Nick Carver commented, “I am very happy with the settlement, glad that it is fully approved by the Court, and honored to have been able to represent many of my friends and former co-workers.”
