Genghis Grill Collective Action Lawsuit
This collective action lawsuit comes in response to a complaint filed on behalf of an ex-employee, alleging substandard wages, unpaid minimum wages, unpaid overtime wages, and unpaid "off-the-clock" work under the Fair Labor Standards Act ("FLSA"). Additionally, the complaint alleges that Genghis Grill required this ex-employee, as well as others similarly situated, to work for less than minimum wages, to contribute to an unlawful tip-pool, to work "off-the-clock" for no pay, and to perform non-tipped job tasks that were unrelated to their tipped occupation while only being paid the tipped minimum wage.
All current and former workers employed by Genghis Grill in Germantown (Chalak Restaurants of Germantown, LLC) as an hourly-paid tipped employee (ex. server, host, hostess, bartender, etc.), or as an hourly-paid non-tipped employee from October 4, 2014 through present day can opt-in to join the lawsuit.

Fair Labor Standards Act Violations
The lawsuit is currently pending in the United States District Court for the Western District of Tennessee which is located in Memphis, TN. The lawsuit claims that Genghis Grill in Germantown violated the Fair Labor Standards Act by failing to properly pay its hourly tipped employees proper wages and allegedly using an improper tip pool.
Generally, the lawsuit seeks to recover unpaid wages for Genghis Grill of Germantown’s improper use of a tip pool, for time hourly-paid tipped employees spent working on non-tipped job tasks unrelated to earning tips, for time hourly-paid tipped employees spent working on non-tipped job tasks that were related to earning tips when such work exceeded 20% of the tipped employees work-time, and for having to work “off-the-clock” for no pay.
