PWCK Statement on Defendants Attempt to Discourage Participation in BIPA Class Action

It has come to the attention of Plaintiffs’ Counsel, Brandon Wise of Peiffer Wolf Carr & Kane, APLC, that Defendants in a class action lawsuit, Macoupin Energy LLC, MaRyan Mining LLC, Hillsboro Energy LLC, and Patton Mining LLC have attempted to discourage participation in a class action lawsuit brought Defendant. On or about April 8, 2019, Defendants began holding mandatory meetings where coal miners were offered $100 to “opt out” of the class action.

Plaintiffs, on their own behalf and on behalf of all class members, have demanded $10,000 per person to settle their claims.
Attorney Brandon Wise who seeks to represent the class said “I think that the $100 offer from the coal mine is a far cry from the $10,000 demand made by Plaintiffs, on their own behalf and on behalf of the class. I think that $100 per person is a ridiculously low offer here, as multiple cases have settled for over $1,000 per person or higher.”
